Auction Company/Seller does not provide shipping. Shipping arrangements are the responsibility of the buyer and any fees associated are at the buyers expense.
Payment Details:
All lots purchased online must be paid by certified check, money order, cashier’s check, cash or bank wire. We DO NOT take credit cards. Paypal payments will be accepted however an additional 2% buyers premium will be added for a total of 15% buyers premium. Internet bidders must pay in full within 24 hours of their email notification to pay for their items.

BUYER’S TERMS AND CONDITIONS
All "ON LINE" bidders must be registered and approved no later than Wed, Dec 1, 2010 @ 4:30 PM Central Time. NO EXCEPTIONS. Anyone planning to attend the auction in person should register on site from 9AM to 3PM on December 1, 2010 and on auction day beginning at 8AM.
Live auctions will be subject to a buyer’s premium of 13% of the purchase price. If bidders elect to pay for their purchases using Paypal, they will be subject to an additional 2% buyers premium for a total of 15% buyers premium.
There will be a $25.00 Notary Charge, payable by the purchaser on all vehicles. No titles or bills of sale will be executed without this fee.
Online bidding during the Live Auction is a fast process, and therefore there is no confirmation given - bids will be taken immediately and are irrevocable.
The highest bidder shall be the purchaser upon the completion of bid verification. Bid verification will commence upon the conclusion of a live auction and may last 24 hours. All winning bidders shall be notified by email within the 24 hour bid verification period.
No bidder shall retract their bid. In the event of a dispute between two or more bidders, the auctioneer, at his sole discretion may put the lot up for resale to the highest bidder.
A bidder is deemed to have accepted an item when making a bid and will be held personally liable for any bids made with their Bidding Number.
The auctioneer reserves the right to accept or reject any and all bids/increments being offered and add, group, delete or match at the auctioneer’s discretion. Any announcements by the auctioneer before the item is bid will take precedence over any previously printed and/or oral statements.
The auctioneer may break down or consolidate any lot or lots at his sole discretion.
ServCorp International, Inc. assumes no responsibility for any liability once a bid is accepted. The buyer assumes full responsibility and assumes risk of loss for all items purchased from the time the Auctioneer says sold to the buyer. It is recommended that purchasers arrange insurance for their purchases in advance.
Buyers shall rely on their own inspection of the items prior to bidding.
All items are sold “as is, where is” with no warranties expressed or implied; the catalogs are prepared as a courtesy and meant as a descriptive guide only. There are no warranties as to the quality, character or condition of any of the items. The implied merchantability is expressly disclaimed. There is no warranty of fitness for a particular purpose
No sale shall be invalidated by any reason or defect or inaccuracy of description in catalog or otherwise, and no liability shall be borne by the auctioneers by virtue of any such fault or error. The equipment is available prior to the Auction for inspection; therefore bidders should inspect all items to determine the condition prior to bidding. Some items may be subject to owner confirmation. All sales final.
Attendance at the auction, preview, or removal by bidders and guests is done at their sole risk. ServCorp International, Inc., their agents, employees or principals, assume no risk or liability, statutory, common law or otherwise whatsoever for the safety of those attending at the auction premises.
Bidder acknowledges that the auction site and anywhere the property to be sold is located or displayed is a potentially dangerous place. Heavy equipment may be being operated, potentially dangerous materials may be present, electric circuits may be live, and other potential dangers may exist. Every person at the sale site (and other areas where the property is located or displayed) at all times shall be there at their own risk with notice of the conditions of the premises, the activities of the premises, potential conditions of the premises and the conduct of third parties and buyer shall so advise his agents and employees. No person shall have any claim against the Auctioneer, their agents, employees or principals for any injuries sustained or death to any person of persons whomsoever nor for damages to or loss of property which may occur from any cause whatsoever. Buyer acknowledges responsibility for any injury or death to any person or persons whomsoever or property damage caused by Buyer, his agents, or his employees.

All applicable sales taxes shall be added to the purchase price. Sales Tax Exemption: You may only use your Sales Tax # to cover purchases that apply under that number. All other purchases are subject to tax. We must have a copy of your Sales Tax Certificate. Failure to furnish this number and certificate will require payment of sales tax. NO Exceptions.
The purchaser is not entitled to possession until all items have been paid for in full. In the event that the purchase prices are not paid within the prescribed time, the auctioneer shall have the right to resell such items in whatever manner he sees fit without notice to the purchaser. Any shortfall from sale plus commission and expenses thereof shall be paid by the purchaser.
Online purchasers must have all equipment removed from sale site 7 days after the sale date unless otherwise stated. The new owner (Buyer) is responsible for dismantling equipment for transport and loading equipment. All costs and responsibilities of removal shall be borne by the purchaser/bidder within the time prescribed by the auctioneer. The auctioneer may require proof of adequate insurance from the purchaser. The purchaser/bidder hereby indemnifies the auctioneer and the seller against any and all damages arising from the dismantling and removal of any lots.
It is the sole responsibility of the purchaser to remove their items within the prescribed time. ServCorp International, Inc. will NOT provide any delivery or transport of any nature for live auction items.
The Auctioneer will use every endeavor to ensure that all Lots appearing in the catalogue for sale are presented for sale at the Auction. The Auctioneer accepts no liability for loss or damage howsoever arising (including but not limited to costs of attendance of Bidders at the Auction) from any Lots not presented for sale.
Neither Auction Company nor seller(s) are in any way responsible, even as faithful administrators, despite the fact that the item remains in their custody. Any lots not removed within the prescribed time shall be subject to storage, moving, disposal and service charges at the sole risk and expense of the purchaser. All such lots shall be deemed as abandoned and shall be subject to resale for the recovery of such charges. The purchaser shall also be liable for any rent or damages sustained by the auctioneer for failure to remove any lot.
If for any reason, ServCorp International, Inc. is unable to deliver any or all of an awarded lot or title thereof, the sole liability of ServCorp International, Inc. shall be the refund of any monies paid on the lot.
