AUCTION DATE/LOCATION Tuesday, October 16, 2007, Ramada Inn,
Sterling, CO 10:30 a.m., MT.
LOCATION Properties being sold are located approximately 2 miles south
of Fleming, CO on CR 79.
OVERVIEW The property being offered for auction appeals to a variety
of buyers looking to purchase dryland, CRP, and rural acreage
to add to their current operation or as an investment for the future.
SALE TERMS/PROCEDURE The "Smith Dryland Auction" is based on
a MINIMUM BID. Property to be offered in 8 Parcels, 2 Combinations, and
a Dryland Unit. The sale of the property is triggered whenever the highest
bid or bids received equal or exceed the MINIMUM BID of $442,500 for
Parcels #1A, #1B, #1C, #2A, #2B, and Parcel #3; MINIMUM BID of
$110,000 for Parcel #4; and MINIMUM BID of $160,000 for Parcel #5. No
parcel sells unless all of the 6 parcels sell within the Dryland unit. Competitive
bids will determine outcome of auction. Sellers agree not to accept and
negotiate any contracts to purchase prior to auction date. Bids will be taken
for total purchase price not price per acre.
SIGNING OF PURCHASE CONTRACT Immediately following the
conclusion of the auction, the highest bidder(s) will enter into and sign a
Contract to Buy and Sell Real Estate (All Types of Properties) for the
amount of the bid. Required earnest money deposit to be in the form of a
personal, business, or corporate check for 5% of the purchase price for Parcel
#4 & #5 and 15% of the purchase price of the remaining properties
which is due upon the signing of the contract and to be
deposited with Reck Agri Realty & Auction. Purchase
contract will not be contingent upon financing. Terms and
conditions of the detail brochure and oral announcements
shall be incorporated and made a part of the contract.
