1. Vehicles are auctioned AS-IS, WHERE-IS (with all faults), WITHOUT WARRANTY or GUARANTEE, either expressed or implied, as to age, year of manufacture, make, model, condition or any other specification. Descriptions of vehicles, either written or oral, are furnished as a guide only. No guarantee as to accuracy of description is made. Some vehicles may have salvage only titles. Salvage only titles and export only vehicles, when known are announced. Absence of mention of salvage title or export only vehicle does not constitute any warranty or guarantee. This auction is conducted WITH RESERVES. The seller reserves the right to approve the final transfer of property to the successful bidder, even after the auctioneer states, “SOLD.” The seller reserves the right to place a reserve price and bid on his/her own lots being offered for sale or bid through the auction administrator or auctioneer, up to the reserve price. In accordance with customary auction rules and procedures, an Auction is not a “pure sale” auction even if one lot offered for sale has a reserve placed on it. Therefore, this auction is conducted with reserves. Seller reserves the right to add/delete vehicles to/from the auction at any time.
2. Bidder warrants that he/she is over eighteen (18) years of age and is legally capable to engage in sales contracts under his/her own recognizance. The placement of a successful bid at the auction establishes a legally binding contract between the successful high bidder and the seller (owner) of the vehicle being sold at auction. The announcement of the high bid amount and the bidder’s number recorded establishes the contract which may be subject to final acceptance by the seller. This contract is bound by these Terms and Conditions as well as special terms and conditions published by the auction house for the specific auction and other Federal regulations governing contracts for the purchase of government property where applicable. The successful bidder is legally bound to pay for property awarded in accordance with his/her bid. The auction house, Rod Robertson Enterprises, Inc., is acting as the agent of the seller. Each registered bidder is solely responsible for the use of his/her bidder number and the transmission of bids via internet, or any use by another person is presumed to be with the consent of and contractually binding on the registered bidder.
3. The bidder is invited, urged, and cautioned to inspect the property/merchandise prior to submitting a bid. The failure to inspect property/merchandise shall not constitute cause for cancellation of sale and no allowance, refunds or set aside will be made on account of any incorrectness, error in cataloging, imperfections, defect or damage. Any descriptions or representations are for identification and reference purposes only and are not to be construed as a warranty of any type. It is hereby warned that bidders should not bid on the basis of photography alone and/or verbal statements heard. The vehicles are available for inspection at the places and times specified. The bidder agrees to rely on his/her personal inspection of the items being offered for sale in the auction.
4. Vehicles are offered for inspection at bidder’s own risk and bidder agrees to hold harmless Rod Robertson Enterprises, in case of any risk, loss, injury or death within the vehicle display area or anywhere in the subject premises. No unattended children are permitted on the auction yard. Children must be accompanied by an adult at all times while on any of our vehicle auction and storage premises. Bidders are subject to search and no large bags or backpacks are allowed.
5. Bidders must register online at minimum 24 hour prior to auction start time. The registration process requires email communication and the payment of the required deposit of $215 via credit card, of which $200 is refundable if bidder remains in good standing. Deposit refund requests must be made by sending an email to auctionpayments@rodrobertson.com. Deposit refunds are usually processed within three days via credit being issued to the credit card on file. Refunds processed via check may take up to two weeks.
6. 10% Buyer's premium, tax, title, license, and a $95 administration fee will be added to bid amount on any/all applicable vehicles purchased. It is bidder’s responsibility to research applicable fees that apply.
7. Forms of payment are (a) wire transfer or (b) cashier's check (payable to Rod Robertson Enterprises). Wire transfers of full invoiced amount is due by 1pm (Central Standard Time) on the very next business day immediately following the sale. For a Saturday sale, the wire transfer is due by 1pm on Monday. Cashier’s Checks (payable to Rod Robertson Enterprises) are due delivered at the auction facility at 11511 Old Perrin Beitel Rd, San Antonio, Texas by 4pm central time, on the next business day immediately following the sale. For a Saturday sale, the cashier’s check is due by 4pm central time on Monday. If payments are not made in full by the specified times and deadlines, bidder will forfeit the $200 deposit and the right to buy the vehicle(s) won. Rod Robertson Enterprises and its subsidiaries reserve the right to reject or decline to do business with any person including bidders that fail to pay for their purchases according to these terms. Vehicles will not be released until full payment has been verified and confirm. Wire transfer payments may take up to 24 to 48 hours to verify and confirm. Wire transfer instructions can be obtained by sending your request to auctionpayments@rodrobertson.com and identifying your name, your bidder’s paddle number, and the vehicle(s) you believe you won.
8. All vehicles must be removed from the storage facility by the 3rd day at 4pm, counting the day of the auction, to avoid incurring storage fees. After the 3rd day the buyer will be given 7 days of storage at the discounted rate of $5.00 per day or $10 per day for medium/heavy duty vehicles. Vehicles not picked up within 10 days will be subject to the standard commercial rates. Vehicles will not be released until full payments are verified. RRE offers vehicle transport for any vehicles purchased at a RRE dismantler or public auction. Check with the local facility manager for transport rates. The vehicle storage fee will be waived if buyer elects to employ RRE for transport. Only original purchaser or representative with authorization letter and valid photo identification will be permitted to remove vehicles from sale area.
9. NO WARRANTY or GUARANTEE is offered as a given condition of any sale, or purchase, made through this auction. Financing and Extended Vehicle Warranties are offered as an element of customer service efforts set forth by Rod Robertson Enterprises. Financing is offered on select vehicles upon pre-approval of credit through Alamo Credit Union. Extended vehicle warranties are offered on select vehicles through SCM. Bidders / buyers interested in these offerings are encouraged to take action and seek additional information regarding same. Bidders are also encouraged to conduct research on vehicle values, title history and all potential factors that may impact the bidder’s decision to bid and buy.
10. Rod Robertson Enterprises reserves the right to change and update published information related to its auction internet listings, lot sequence, vehicle descriptions and photos before auction begins.
