All other items will be shipped via UPS or USPS at the customers expense plus handling if no other arrangements are made by Tuesday 10-2.
Texas State Sales tax of 8.25% will be collected from ALL buyers taking possession of their purchases in the State of Texas with the exception of vehicles and equipment where titles are available.
As required in rule changes in T.A.C., Title 34, Part 1, Chapter 3, Subchapter O, Rule 3.320 the following surcharges must be collected per tax code. Effective with those bids open after July 1, 2003 and the auctions held after that date, surcharge of 2% on the purchase of off-road, heavy duty, diesel construction equipment.
New Tax Exemption Requirements as of 01/01/12:
Texas House Bill 268, passed during the 82nd Regular Legislative Session (2011), requires that a person claiming an exemption from sales tax on the purchase of certain items used in the production of agricultural and timber products must provide a registration number issued by the Comptroller of Public Accounts on the exemption certificate issued to the seller. All buyers who wish to claim tax exempt (farm use or non-profit) or resale to have taxes legally removed from their invoice MUST (1) PROVIDE A COPY of their RESALE TAX CERTIFICATE for M H R’s records and (2) a tax deductible form will need to be furnished by buyer and completely FILLED OUT. No paid receipts will be issued with tax deduction unless the required information is received at the time of payment. NO EXCEPTIONS!

If items are not picked up at the M H R Springtown, Texas location then you must contact us before bidding to set up shipping information.
Shipping cost is the responsibility of the bidder/buyer and will be billed to the credit card on file if other arrangements have not been made. The shipping/freight charges are beyond the hammer price of your auction item and cause the price to increase accordingly. Figure shipping into your item cost when placing your bids unless you plan to pick the items up at M H R’s location in Springtown, Texas.
A valid credit card number must be on file with M H R in order to bill you for shipping costs. If the charge does not clear, your item/items will not ship. If your payment for the item/items cleared, but the charge for shipping does not then you will have 72 hours to correct this issue. If not corrected, you will be considered in default of your bidding contract. The item will then be forfeited and re-auctioned or offered to next highest bidder. You will also have forfeited the cost of the item, buyer premium & sales tax. If shipping is arranged through M H R, the preferred providers are US Postal Service or United Parcel Service. If the buyer prefers a different method of shipping, all arrangements are the sole responsibility of the buyer but before releasing the items to a third party the buyer must send a release letter, in writing, explaining all details of such release to M H R.
Buyers will be responsible for all shipping costs including insurance, boxes, wrapping, packing material and labor for shipping or handling fees. Lots will be combined for one shipping charge if possible.
Items that are paid for and to be picked up at M H R facility in Springtown, Texas must be picked up within seven ( 7 ) days after the closing date. M H R is willing to work with buyers that are a long distance from Springtown or have other reasonable reasons for delayed pick ups. Unless an agreement has been reached in writing, with M H R the item or items are subject to storage fees or in default. The buyer may also have forfeited the cost of the item, buyer premium and sales tax if in default.
Payment Details:
Cards to be processed immediately after purchase. Will need card type, account number, expiration date and 3 digit security code from back of card.
PAYMENTS: Bidder agrees that auctioneer has the right to charge your credit card at the drop of the hammer. The winning bid cannot be retracted, all sales are final.
Bidder further agrees that under no circumstances will bidder initiate a charge-back on bidder's credit card for any purchase made in an auction.
Payment must be received before picking up your winning item/items or before your item/items are shipped. A 25 % reselling fee will be applied to purchases not paid in full in 7 days or a purchase returned or a purchase disputed for any reason.
Please print your invoice and bring it with you, along with proper ID, the day of pick up. You must have your invoice and ID so that the MHR staff can confirm payment before checking out your items. This is for the security and protection of both the buyer and seller. All sales are final and a 13 % Buyer Premium with a 3 % CASH discount is applied to final bid amount. All purchases are subject to the applicable sales tax rates, currently 8.25%, unless the buyer provides a valid tax-exempt certificate at the time of payment.

Bidders that fail to claim, pay for, and remove auction items from M H R premises by seven days (7) pick-up day, may forfeit their rights to the auction item, and be declared as a default bidder/bidders. M H R may ban a default bidder from participating in future online auction events with icollector.com and MHR. If one item goes into default, all items won by the bidder can go into default and are subject to resale.
If unclaimed or payment is not received by the winning bidder/bidders, M H R reserves the right to re-auction or award the item to the next highest bidder. Bidder agrees that this agreement is to be governed by the laws of the state of Texas, with jurisdiction in Springtown, Parker County, Texas. Should M H R have to engage an attorney for the collection of any sums not paid according to the terms of this agreement, M H R is entitled to recover its reasonable and necessary attorney’s fees and all other costs for collection.
DECLINED CREDIT CARDS: Any bidders with credit cards that are declined on reconciliation day will be charged a $20 processing fee to run another credit card- NO EXCEPTIONS!

INSPECTION: All items are sold 'AS IS' and 'WHERE IS' with no warranty implied or expressed. The descriptions and dimensions given in this auction are believed to be correct, but are not guaranteed. The appraised values given were provided by professionals, but are to be used only as a guide as to the value of a similar item. It is the sole responsibility of the buyer to determine the condition of the property that is up for auction. Prospective bidders are encouraged to inspect the property prior to bidding, and to place bids based solely on their personal inspection and evaluation. OWNERSHIP: At the end of the auction, the highest bidder has entered into a binding contract with M H R. The buyer is obligated to pay the price bid, plus buyer's premium and sales tax (Unless exempt – see exempt status BELOW). Placing the winning bid, but not paying for the product, is illegal in most states, and may result in prosecution. Bidder agrees that this agreement is to be governed by the laws of the state of Texas, with jurisdiction in Springtown, Parker County, Texas. INDEMNIFICATION: In consideration for the right to enter this auction, the buyer or bidder hereby releases and agrees to protect, indemnify and hold harmless M H R and the respective heirs, agents, employees and assigns from and against any and all claims, demands, causes of action and damages, including attorneys' fees, resulting from any accident, incident or occurrence arising out of, incidental to or in any way resulting from the use of this M H R auction site.
LIABILITY: Items are offered for sale using the services and web site of the online auction services contractor. Under no circumstances will the M H R Auction Group be liable to any person or business entity for any direct, indirect, special, incidental, consequential, or other damages or losses based on, or caused by, any use of the auction web site, or any other web site to which the site is linked, the content of such web sites, or any viruses or other harmful components derived from any such web sites, including, without limitation, any lost profits, revenue, or use, business interruption, or loss of computer programs or information. M H R strives to make the online auction system as accurate as possible. However, errors and equipment malfunctions are possible and may occur without notice. In case of malfunctions of hardware or software, M H R reserves the right to cancel any sale, even if an award notification e-mail has been received. M H R cannot and will not guarantee uninterrupted access to the auction system.
APPLICABLE LAW: Although this site may be accessed from any state or country, bidders who participate in this auction agree that the laws of the State of Texas shall govern all matters relating to the use of this auction and purchase of items listed by

CHOICE OF LAW and DISPUTES: The law of the state of Texas shall govern the interpretation of any & all disputes or other matters relating to the subject sale &/or stemming from this auction sale. Venue & jurisdiction of any & all disputes which may arise by virtue of this auction sale or stemming from this auction sales shall be in the court of Parker County, Texas USA. Any disputes initiated by the buyer or bidder that escalates into legal ramifications will hold bidder or buyer liable for ALL attorney fees.
