LAS VEGAS AUCTION LLC – TERMS AND CONDITIONS
AGE REQUIREMENT: You must be at least 18 years old in order to place a bid
REGISTERED BIDDER / AUCTION DEPOSIT: Bidders are required at each auction to make a $100 refundable deposit at the registration window in the front office before bidding. Deposits are refunded if no purchase is made, otherwise it will be applied to the bidders invoice. There will be a 10% Buyers Premium and State Sales tax added to your purchases. Deposits are forfeit if a customer bids on an item and refuses to pay.
ALL SALES ARE FINAL: There is a 10% buyers premium. There are no returns or exchanges. All items are sold as is, where is, with all faults, imperfections, omissions and errors in the written description and photography. Neither Las Vegas Auction nor the auctioneer is responsible for any errors or omissions in the description or photography provided. Verifying the condition and description of an item is the sole responsibility of the bidder prior to placing any bids.
TERMS OF SALE: Payment for purchases must be made by cash, certified check, or credit card (Visa MasterCard, & Discover) on the day of the sale. If unexpected large purchases are made and you are unable to pay your bill in full on the day of the sale, a deposit of 20% or $500 (whichever is less) will be required to hold your purchases for 2 days, by which time the balance should be paid in full. Items not fully paid for by the close of the 2nd business day at 5:00 PM will be considered abandoned and deposits forfeited. Exceptions require approval from the auction office. Credit card payments that are charged back will automatically preclude the purchaser from any future auctions.
RECEIPT: Buyers will be furnished a receipt at the completion of the auction. This receipt must be authenticated by a Las Vegas Auction Representative for check-out before collection and removal from Las Vegas Auction. Removal of items during the auction will be allowed only with the assistance of an authorized Las Vegas Auction Representative and only if the representative determines that the removal will not interfere with the remainder of the auction proceedings. Once items purchased are collected by the auction agents, they will be presented to the Buyer for verification at the designated pickup areas. It is the responsibility of the Buyer to make sure that all items purchased are accounted for.
REMOVAL: Merchandise becomes the full responsibility of the buyer at the time of purchase and buyer assumes all risk of loss and damage to property. All consigner and buyer merchandise in the current auction may only remain on the sale premises for the announced period of time (usually until the close of the business day the Monday following the auction unless announced or arranged otherwise). Purchased lots not claimed by the end three business days following the auction will be considered abandoned and any payment made for the lot will be forfeit, and will become the property of Las Vegas Auctions.
ABANDONED LOTS: Abandoned lots become the sole property of Las Vegas Auction and will be donated, disposed of, or sold at the discretion of Las Vegas Auction. All proceeds and profits collected from the sale of abandoned lots will belong solely to Las Vegas Auction.
ONLINE PREVIEW / BIDDING: Online auction previews and schedules are available at www.lvauction.com. Live bidding is available at www.lvauctionlive.com. Pre/proxy bidding is also usually available 24-48hrs prior to the start of the auction at the same site.
INTERNET BIDS. Las Vegas Auction provides two venues for placing bids online: Proxy or Pre bidding in which offers are made before the auction and the house bids in your behalf until a your offer is met, and Live bidding in which online bidders may listen to our auction live and place bids real time. In the case of each, the internet “ringman” will provide audio and visual cues to alert for incoming bids via these venues. If you place a proxy or pre bid be aware that the house gives preference to live bidders. This means that if your maximum bid is $20 and a customer on the floor or live online bids $20 the resulting sale goes to the live bidder, just as if you had both bid $20 at the same time on the floor and another customer’s bid was taken. Since you are not present to up your bid, your bidding stops.
INTERNET SALES. Internet sales are charged to the card on file at the close of the auction. If the charge does not go through, internet customers will be notified and given an opportunity to provide an alternative method of payment. Internet customers will only be allowed till the close of business on the Monday following the auction to make full payment on the items they purchased. Internet customers pay a 12.5% premium.
DISPUTES BETWEEN BIDDERS OR WITH AUCTIONEER: The Auctioneer will designate the purchaser of each item at the close of the bidding. His decision is final. The Auctioneer reserves the right to re-open bidding on any lots at his discretion and can do so for any reason.
CHILDREN: All children must be attended at all times by their parents or guardians. Any property damage resulting from a child under the bidder’s care will be accountable to the bidder. Repeated negligence of children will preclude the bidder from future auctions.
PETS AND OTHER ANIMALS: Leave them home.
INJURY AND DAMAGE: Bidders and consignors acknowledge they are fully responsible for any personal injury or property damage caused by themselves or their agents and agrees to hold harmless Las Vegas Auction and auctioneer.
